Solo and small firms lag on AI, and intake chatbots are a suggested start

Clio's lawyer in residence, discussing Clio's 2025 report on small firms, said they've barely dipped their toes into AI.

Use case estimate: 1 to 3 hrs a week ours, not theirs
Read more

What they did. Clio studied solo and small firms. Its lawyer in residence suggested intake chatbots, promotional emails and first drafts for flat-fee matters as places to start.

How it went. Utilization rates were 27% for solos and 32% for small firms, versus about 50% at mid-sized firms, per Clio's report.

Worth knowing. These are suggestions and industry data, not one firm's results.

Their number. 59% of solo and small firms name referrals as their top lead source (reported by Clio).

The ABA Journal rounds up AI intake and lead-screening tools

A Practice Technology column surveys virtual receptionists and AI chat for small firms, including AI-powered website chat that captures and qualifies leads.

Use case estimate: 1 to 2 hrs a week ours, not theirs

What they did. Describes tools like Smith.ai's AI-first receptionist, Intaker's AI website chat and LawDroid's virtual intake.

How it went. A survey of options, not one firm's results.

Worth knowing. The author works at MyCase, a practice management vendor. She warns that outsourcing intake means sharing firm data, which triggers confidentiality duties.

What goes wrong: lawyers sanctioned for ChatGPT's fake cases

In Mata v. Avianca, a federal judge in New York sanctioned two lawyers and their firm for a brief that cited cases ChatGPT made up.

Use case estimate: 2 to 4 hrs a week ours, not theirs
Read more

What they did. A lawyer used ChatGPT for research, and the brief cited decisions that didn't exist.

How it went. The court found bad faith, imposed a $5,000 sanction, and ordered them to notify their client and the judges whose names were falsely used.

Worth knowing. This is why every AI citation and fact has to be checked against the source.

Nothing matches those filters yet.

Where the week goes

  • Calls after hours and during court go to voicemail, and prospective clients call the next firm.
  • Consults that don't sign right away rarely get a second follow-up.
  • Clients call to ask what's happening with their case.
  • Long records and first drafts eat evenings and weekends.
  • Time entries need cleaning up into billing narratives every month.

Common questions

Yes, with care. Florida Bar Ethics Opinion 24-1 and Texas Opinion 705 both allow it if lawyers protect confidentiality, verify output, and bill fairly. Check your own state bar's guidance.

Filing something AI got wrong. In Mata v. Avianca, a federal judge sanctioned lawyers $5,000 for a brief that cited cases ChatGPT made up. Verify every citation and fact.

Less than larger firms. Clio's 2025 report on solo and small firms, as reported by Canadian Lawyer, found they lag mid-sized firms in adoption.
